Purpose of This Notice

This Notice of Privacy Practices (“Notice”) describes how we may use and disclose your protected health information (“PHI”) and explains your rights regarding that information. We are required by law to:

  • Maintain the privacy and security of your PHI

  • Provide you with this Notice of our legal duties and privacy practices

  • Follow the terms of this Notice currently in effect

This Notice applies to Artemis Hill Recovery, Inc. dba The Runway Recovery (“The Runway Recovery,” “we,” “us,” or “our”) and our workforce members involved in your care.

The Runway Recovery is a detox and residential addiction treatment program in Santa Ana, California, offering holistic treatment for men and women dealing with drug and alcohol dependency.

Your Rights

When it comes to your health information, you have certain rights. This section summarizes those rights and our duties.

You have the right to:

1. Inspect and Obtain a Copy of Your Records

You can ask to see or get a copy of your medical and billing records and other health information we have about you. We will provide a copy or summary within the timeframes required by law. We may charge a reasonable, cost-based fee as permitted.

2. Request an Amendment

If you believe that information in your record is incorrect or incomplete, you can ask us to amend it. We may deny your request in certain circumstances, but if we do, we will explain why in writing.

3. Request Confidential Communications

You can ask us to contact you in a specific way (for example, at a different mailing address or phone number). We will accommodate reasonable requests.

4. Request Restrictions

You can ask us not to use or disclose certain information for treatment, payment, or healthcare operations. We are not required to agree to all requests, but we will consider them.

If you pay out of pocket in full for a specific service, you may request that we not share information about that service with your health plan, unless we are required by law to do so.

5. Receive an Accounting of Disclosures

You can request a list (accounting) of certain disclosures of your PHI made during a time period specified by law, excluding disclosures for treatment, payment, healthcare operations, and certain other exceptions.

6. Receive a Copy of This Notice

You can ask for a paper copy of this Notice at any time, even if you agreed to receive it electronically.

7. Choose Someone to Act for You

If you have given someone medical power of attorney or you have a legal guardian, that person can exercise your rights and make choices about your health information, as allowed by law.

8. File a Complaint

If you believe your privacy rights have been violated, you can file a complaint with us and/or with the U.S. Department of Health and Human Services (HHS). We will not retaliate against you for filing a complaint.

Your Choices

In certain situations, you have choices about how we use and share your information. If you have a clear preference for how we share your information in the situations described below, tell us, and we will follow your instructions when possible.

You may have choices about:

  • Sharing information with family members or others involved in your care

  • Sharing information in a disaster relief or emergency situation

  • Limited use of your information for fundraising or simple outreach communications (if applicable)

In certain cases, we must obtain your written authorization before we can share specific information, such as psychotherapy notes, most marketing communications, or any sale of PHI.

Our Uses and Disclosures

We typically use or share your health information in the following ways:

1. For Treatment

We can use your PHI and share it with other professionals who are involved in your care.

Example: Your clinician may consult with another healthcare provider about your detox plan or aftercare recommendations.

2. For Payment

We can use and disclose your PHI to bill and receive payment from you, your health plan, or other payers.

Example: We may share necessary information with your health insurance plan to verify benefits or obtain prior authorization for detox or residential treatment.

The Runway Recovery is in-network with certain health plans, including Anthem Blue Cross, Blue Shield of California, MHN (a Health Net company), and TRICARE, and accepts many PPO insurance plans. Information disclosed for payment will be limited to what is reasonably necessary.

3. For Healthcare Operations

We can use and disclose your PHI to run our program, improve services, and manage our organization.

Example: We may use your information to evaluate the quality of care, train staff, or conduct internal audits.

Other Uses and Disclosures Permitted or Required by Law

We may use or disclose your PHI without your authorization when:

  • Required by federal, state, or local law

  • Responding to a court or administrative order, subpoena, or other lawful process

  • Reporting suspected abuse, neglect, or domestic violence, as required by law

  • Assisting public health and health oversight activities, such as audits, inspections, or investigations

  • Responding to law enforcement officials in specific, legally permitted circumstances

  • Addressing workers’ compensation, disability, or similar programs

  • Preventing or reducing a serious and imminent threat to the health or safety of you or others, consistent with applicable law

Special Protections for Substance Use Disorder Records (42 C.F.R. Part 2)

Because The Runway Recovery provides substance use disorder services, many of your records are protected by federal confidentiality laws, including 42 C.F.R. Part 2, in addition to HIPAA.

Under these laws, we generally may not disclose information that identifies you as having, or having had, a substance use disorder, or as being a patient in our program, unless:

  • You give written consent that meets specific legal requirements;

  • The disclosure is allowed by law (for example, in a bona fide medical emergency, for certain audits or evaluations, or with a valid court order); or

  • Another narrow exception applies.

A general authorization to release medical information is not sufficient to permit the disclosure of substance use disorder treatment records. We will provide more details about these protections in our consent forms and intake documentation.

Our Responsibilities

We are required to:

  • Maintain the privacy and security of your PHI

  • Notify you as required if a breach occurs that may have compromised the privacy or security of your information

  • Provide you with this Notice and follow the terms currently in effect

  • Not use or disclose your PHI in a way that is not described in this Notice unless you authorize us in writing

We may update this Notice from time to time. Any revised Notice will apply to all PHI we maintain and will be made available at our facility and, when possible, on our website.
